WASHINGTON, D.C. (Press Release) – Three Jewish UCLA students and a Jewish professor asked a federal court Friday, Feb. 28, to ensure that UCLA can never again help antisemitic agitators ban Jews from campus.
In Frankel v. Regents of the University of California, a federal judge ordered UCLA last year to stop assisting the agitators, calling the exclusion of Jews from campus “abhorrent” and “unimaginable.” The students and professor, represented by Becket with co-counsel Clement & Murphy PLLC and Davis Polk & Wardwell LLP, are now asking the court to make its ruling permanent so that Jews at UCLA will never face such antisemitic exclusion in the future.
Last year, federal judge Mark C. Scarsi ordered UCLA to stop assisting antisemitic agitators who set up a Jew Exclusion Zone on campus, blocking Jews from accessing classes, the library, and other critical areas of campus. UCLA helped the agitators by providing metal barriers, stationing security to shoo Jews away, and catering to the wishes of the agitators instead of ensuring safe passage for Jewish students. These actions were documented in a report filed by UCLA’s own Task Force to Combat Antisemitism and Anti-Israel Bias, which admitted the University had fostered an antisemitic environment. For example, the Task Force Report condemned UCLA’s own behavior as “de facto or structural antisemitism” and “fail[ing] in its legal obligation to protect First Amendment rights to the free exercise of religion.”
The Department of Education’s Office for Civil Rights and the U.S. House of Representatives Committee on Education and the Workforce similarly faulted UCLA for violating its students’ and faculty’s rights. In particular, the House committee chastised UCLA for “st[anding] by and fail[ing] to act as the illegal encampment violated Jewish students’ civil rights and placed campus at risk.” Meanwhile, UCLA continues to insist that it bears no blame for the rampant antisemitism it hosted and facilitated.
“The need for permanent protection for Jews like me has never been more pressing. UCLA has never owned up to its role in facilitating antisemitism, even as the masked mob continues to escalate by harassing a Regent at his house and rioting on campus to intimidate Jews,” said Yitzchok Frankel, a third-year law student at UCLA. “UCLA simply cannot be trusted to protect its Jewish community, and I hope Judge Scarsi will vindicate our rights once again.”
Frankel is a law student and father of four who faced antisemitic harassment last year for simply wearing a kippah and was forced to abandon his regular routes through campus because of the Jew Exclusion Zone. Frankel detailed how UCLA’s actions forced him to cancel plans on campus with his family and forgo opportunities to mentor incoming Jewish students on campus. Eden Shemuelian, another law student, also had to avoid using campus facilities and participating in law school orientation events because of UCLA’s refusals to ensure safety and equal access for Jewish students. With another Jewish student and professor, they are asking the court to ensure that this kind of antisemitism will not be allowed on campus in the future.
“UCLA didn’t just stand idly by—it actively helped an antisemitic mob exclude Jews from parts of its campus,” said Mark Rienzi, president of Becket and an attorney for the students and professor. “Such a grotesque failure of leadership has no place in higher education. We’re confident the court will ensure that no Jew at UCLA will ever be segregated on their own campus again.”
A ruling from the court is expected in the coming months.
